Welcome to Timothy Van Vuuren Photography. Please read these terms and conditions carefully before making any purchases. By accessing or using the services provided by Timothy John Jansen Van Vuuren, you agree to be bound by these terms and conditions. If you do not agree with any part of these terms, you may not access the service.
1. Products and Services: Timothy John Jansen Van Vuuren offers a variety of high-quality prints of original photographs for purchase by customers worldwide. All products are subject to availability.
2. Ordering: To place an order, customers must provide accurate and complete information. I reserve the right to refuse or cancel any order at any time for reasons including but not limited to product availability, inaccuracies, or errors in pricing or product information.
3. Shipping: I strive to deliver orders in a timely manner. However, please note that delivery times may vary depending on the destination. Customers are responsible for any customs duties and taxes that may apply to their orders when they arrive in their destination country.
4. Payment: All prices are listed in USD but most currencies are accepted. I accept payments via debit/credit card through PayPal. Proof of Payment documents are not accepted as confirmation of payment. Full payment is required, and the total amount must be reflected on my end before the printing and delivery process commences.
5. Returns and Refunds: I want you to be completely satisfied with your purchase. If for any reason you are not satisfied, please contact me within 2 days (48 hours) of receiving your order for assistance. Please note that certain conditions apply for returns and refunds. Please see below in detail under the heading 5. RETURN AND REFUND POLICY.
6. Copyright and Use: All printed photographs sold by Timothy John Jansen Van Vuuren are protected by copyright. The purchase of any product does not provide the buyer with the copyright or any reproduction rights of the images in any way whatsover. Customers may not reproduce, distribute, redistribute or sell the photographs without prior written permission from Timothy John Jansen Van Vuuren. Customers purchasing prints of photographs taken by Timothy John Jansen Van Vuuren acknowledge that they are entitled solely to the physical printed photograph that they purchase and receive. No rights to the RAW or digital images and fomats associated with the photographs are transferred or included in the purchase. All rights and ownership to the RAW and/or any digital formats of the images remain the sole property of Timothy John Jansen Van Vuuren.
7. Limitation of Liability: Timothy John Jansen Van Vuuren shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
8. Colour Representation Disclaimer: Every effort has been made to accurately display the colours and tones of the photographs presented in the online store. However, colours may vary slightly between different monitors, screens, and devices. Printed photographs may therefore differ slightly from how they appear on screen due to variations in display calibration, printing processes, paper types, and lighting conditions. Such minor variations are considered normal within professional photographic printing and do not constitute a defect or grounds for return or refund.
9. Print Production Tolerances: Due to the professional printing and finishing processes involved in producing photographic prints, minor variations in trimming, border width, or final dimensions may occur. These small variations are considered standard industry practice and do not constitute a defect or grounds for return or refund.
10: Shipping and Carrier Responsibility: All orders are shipped via reputable third-party shipping carriers. Once an order has been dispatched and tracking information has been provided, responsibility for the shipment transfers to the carrier. Timothy John Jansen Van Vuuren is not responsible for delays, loss, or damage caused by shipping carriers. However, reasonable assistance will be provided to customers in resolving shipping issues with the carrier where possible.
11. Lost or Missing Shipments: If a shipment is confirmed lost in transit by the shipping carrier, we will work with the carrier to investigate the matter and determine an appropriate resolution. Customers may be required to cooperate with carrier investigations or documentation requests. Replacement prints or refunds will only be issued once the carrier has confirmed that the shipment is officially lost.
12: Pricing Errors: While every effort is made to ensure pricing accuracy, errors may occasionally occur. Timothy John Jansen Van Vuuren reserves the right to cancel or refuse any order placed for a product listed at an incorrect price due to typographical error, technical error, or incorrect pricing information.
13. Force Majeure: Timothy John Jansen Van Vuuren shall not be held liable for failure or delay in the performance of obligations where such failure or delay results from events beyond reasonable control, including but not limited to natural disasters, acts of government, strikes, supply chain disruptions, carrier delays, pandemics, war or other unforeseen circumstances.
14. Prices: Please note all prices quoted/indicated are non negotiable. They are exclusive of shipping costs. Shipping costs vary depending on region and print store used and will be calculated accordingly to each specific order placed and included thereafter in the invoice. Prices are inclusive of actual processing and printing of the image.
15. Import Tax/GST/VAT: We use DDU declaration process. Delivered At Place (DAP). Also called delivered duty unpaid (DDU). This term indicates that the seller only takes responsibility for organising the logistics of shipping the product, and requires the customer to pay any import costs, such as VAT/GST/Import taxes, duties, and clearing fees. The recipient is the importer of record and must comply with all laws and regulations of the destination country. Orders shipped outside of South Africa or Australia (Depending on where the print is developed & shipped from at the time of order) may be subject to import taxes, customs duties and fees levied by the destination country. The recipient of an international shipment may be subject to such import taxes, customs duties and fees, which are levied once a shipment reaches the recipient's country. Additional charges for customs clearance must be fulfilled by the recipient. Our company has no control over these charges, nor can we predict what they may be. Customs policies vary widely from country to country. You can contact your local customs office for more information. VAT (Value added tax) / GST (General Sales Tax) is not included in product price thereby preventing double taxation to the customer, since the importing country may charge their own taxes.
16. Framing & Custom print Orders: Framing is not offered for custom print orders placed outside of the integrated online store. All custom print orders, both domestic and international, are supplied unframed and will be carefully rolled and shipped in a protective hard tube. It is the purchaser’s responsibility to arrange framing upon receipt of the print. Please note that custom prints include a white border surrounding the photograph. This border is intentionally included to accommodate the selected paper size and to assist with professional mounting and framing. Due to post-processing and aspect ratio considerations, the photograph may not extend precisely to the full edge dimensions of the selected paper size.The white border ensures the image is printed without distortion or unwanted cropping while maintaining the integrity of the original composition. By placing a custom print order, the purchaser acknowledges and accepts these conditions.
17. Print cropping notice: All photographs are created and composed in their original aspect ratio. Certain print sizes and framed products through the online store may require slight cropping in order to fit the proportions of the selected print or frame size. Where applicable, customers will be provided with a crop preview tool during the ordering process to adjust the composition of the image to their preference. By placing an order, the customer acknowledges and accepts that minor cropping may occur to accommodate the selected print size or frame format. While every effort is made to ensure the best possible presentation of each image, it is ultimately the customer’s responsibility to review and confirm the crop preview before completing their purchase. Due to the nature of photographic aspect ratios and print manufacturing requirements, slight variations in cropping and trimming may occur during production. These minor adjustments are considered standard within professional photographic printing and do not constitute a defect. Orders placed through the store confirm acceptance of these terms.
18. Governing Law: These terms and conditions are governed by and construed in accordance with the laws of South Africa, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.

Intellectual Property Notice
By purchasing a print from me, you acknowledge that the photograph remains the intellectual property of the artist (Timothy John Jansen Van Vuuren). Your purchase grants you ownership of the physical print that you receive only and does not include any rights to reproduce, distribute, redistribute or create derivative works from the photograph. Any unauthorised reproduction or use of the image is strictly prohibited and will be subject to legal action.
Timothy John Jansen Van Vuuren reserves the right to modify or replace these terms and conditions at any time without notice.
5. RETURN AND REFUND POLICY
We take great pride in the quality of our photographic prints and strive to ensure that every order meets the highest standards. Due to the custom nature of photographic print production, all sales are considered final except under the circumstances outlined below.
A. Damaged or Defective Items
If you receive a print that has been damaged in transit or is defective, you must notify us within 2 days (48 hours) of delivery.
To initiate a claim, you must provide clear, high-resolution photographic evidence of:
The damaged print
The packaging (including outer shipping box and internal packaging)
The shipping label
This documentation is required for insurance and verification purposes.
If the claim is approved, the damaged item must be returned before a replacement or refund is issued. The print must be returned in its original packaging or in packaging that provides equivalent protection.
Once the returned item has been received and inspected, we will either:
Issue a replacement print, or
Provide a refund at our discretion.
If the damage is determined to have occurred during shipping, we will cover the cost of the replacement print and associated shipping. If the damage is determined to have occurred after delivery due to improper handling or storage by the customer, the return or refund request may be declined.
B. Incorrect Orders
If you receive an item that differs from the product originally ordered, please notify us within 2 days (48 hours) of receiving your order. Once the issue has been verified, we will arrange for the incorrect item to be returned at our expense. Upon receipt of the returned item, we will either dispatch the correct product at no additional shipping cost or issue a full refund, depending on product availability and customer preference.
C. Shipping Issues
We and our professional print partners take great care in packaging all orders. However, shipping carriers operate independently and delivery delays may occur.
Customers are responsible for monitoring shipment tracking information and ensuring that packages can be received at the delivery address provided. We are not responsible for delays caused by customs processing, carrier delays, or incorrect delivery information supplied by the customer.
If a package is confirmed lost in transit by the shipping carrier, we will assist in filing a claim and determining an appropriate resolution.
D. Return Conditions
Approved returns must meet the following conditions:
The item must be returned in its original condition.
The item must be securely packaged to prevent damage during return transit.
Returns must be shipped within 7 days of return authorisation.
Items returned without prior authorisation may not be accepted.
E. Exemptions
Except for the circumstances outlined above, all sales are final.
Returns or refunds will not be accepted for the following reasons:
Change of mind
Incorrect size selection by the customer
Dissatisfaction with the artistic style or composition of the photograph
Minor cropping required to fit selected print sizes
Slight colour variations between digital displays and printed photographs
Normal production tolerances in trimming, borders, or print dimensions
These variations are considered standard within professional photographic printing and do not constitute a defect.
F. Refund Processing
Approved refunds will be issued using either the original payment method used during purchase or alternate methods such as a direct bank transfer. Refund processing times may vary depending on the payment provider but typically take 5–10 business days once the returned item has been received and inspected.

Timothy John Jansen Van Vuuren reserves the right to determine the eligibility of items for return and modify or update this Return and Refund Policy at any time without prior notice.
